How Does an Insurance Claim Work in New Jersey?

New Jersey is unique in that it uses a “choice” no-fault insurance law. This means that drivers often must turn to their own insurance companies first to obtain financial benefits. In New Jersey, all drivers must purchase at least $15,000 in personal injury protection (PIP) coverage. This coverage will pay for the driver’s medical expenses, regardless of fault for the car accident.

There is an exception, however, if the driver chose to purchase “unlimited right to sue” insurance rather than “limited right to sue” insurance. With unlimited right to sue insurance, a driver does not have to depend on his or her own PIP coverage for benefits. Instead, the driver will have the right to file a claim against the other driver’s insurance provider if the other driver caused a car accident.

There is another exception involving a serious injury threshold. According to New Jersey Statutes Annotated Section 39:6A-8, if a crash victim suffers a bodily injury that results in significant scarring or disfigurement, dismemberment, displaced fractures, a permanent injury, the loss of a fetus, or death, the victim can bring a lawsuit against the at-fault party even with limited right to sue insurance.

Will You Need to File a Lawsuit?

The vast majority of car accident claims in New Jersey are resolved at the settlement stage, with no need for either party to go to trial to resolve the dispute. You can most likely achieve a successful settlement from your insurance provider or the insurance carrier of the at-fault driver without needing to go to trial, especially with help from an attorney.

If, however, the insurance company refuses to offer fair compensation for your injuries and losses, our lawyers are always prepared to go to court. We can let you know if you have grounds to bring one or more defendants to court, as well as whether this is the right legal action for you.
